Just as an FYI, since January 2011 all proposals to NSF must include a data management plan that articulates exactly how the PI intends to make his or her data accessible to others. So in principle this problem is now solved, at least for new NSF-funded research. See http://www.nsf.gov/bfa/dias/policy/dmp.jsp for details.
