You could do:
for k = 1:5;
linestr='r-';
if ( j ==2 ); linestr='k-o'; end
figure(figcounter);plot(x_data(i,j,k), y_data(i,j,k),linestr);hold on
if ( j ==2 )
legend('Data 1','Data 2')
end
figcounter = figcounter + 1;
end

Does that do the trick?
